Dispute Resolution

International experts in dispute resolution

Disputes of any kind are rarely gratifying or preferable, but sometimes they simply cannot be avoided. The team at the Global Construction & Infrastructure Legal Alliance (GcilA) takes great pride in providing our clients with the most innovative approach to any problem they might encounter when it comes to the management, avoidance and resolution of disputes. Depending on your requirements, the team at GcilA can seek to help through extrajudicial efforts, aiming to avoid any formal proceedings, namely our advanced dispute resolution (ADR) services. We also apply our extensive experience in dispute boards, counsels and as experts and arbitrators to the successful resolution and avoidance of disputes of any kind. The lawyers at GcilA act precisely based on our clients’ needs and wishes in order to achieve the best possible outcome while minimizing any risks; no matter what the scope or nature of the dispute may be.

Our procedures involve an early assessment of our client’s situation in order to gain a greater understanding of complex scenarios and issues. We will further investigate any options that are available; thus being able to recommend the best path to take and strategy to use aiming at resolving the disputes for our clients. We also understand the sensitive nature of dispute resolution cases and guarantee complete confidentiality for both parties.

We are well experienced in infrastructure and construction disputes as well as complex scenarios in the energy and industrial sectors. As one of the global leaders in this area, we strive to provide clients with our outstanding advocacy and trial skills, while understanding the necessity of preserving important relationships and maintaining the client’s long-term interests. Our global approach to any service that we offer, guarantees that we can be at the root of the issue, serving our client’s best interests. Our experience stretches over several dozen countries and all continents, where we offer high quality legal advice and assistance and effectively resolve and prevent disputes.

Dispute boards

Actively using dispute boards is one technique of our advanced dispute resolution (ADR) services. As members of dispute boards, we understand the client’s need to avoid any dispute before it can even arise. By undertaking regular visits to the construction site and seeking active involvement in any process throughout the entire project, the team at GcilA can successfully avoid disputes and guarantee a flawless development of the project while helping the client with any possible issues.

Our international arbitration practice provides our clients with all the means and help to efficiently and effectively resolve any dispute that arises within the development of their project(s). From the drafting of dispute resolution clauses to the conduct of proceedings, through to the enforcement of arbitral awards, the team at GcilA provides the efficient, neutral means of resolving international disputes. We strive to serve in the best interest of our clients and try to ensure success, whether you are a government entity, an individual, a business or an international organization.

Expert witness

Lawyers at GcilA regularly act as expert witnesses for the resolution of disputes. Rather than to judge or act as an arbitrator, the independent third party nature of the expert witness allows our team to look objectively at the dispute and act in the best interest of each party involved. As an independent expert, we make proper and reasonable investigations in order to arrive at a non-negligent decision that serves all parties involved in their best interest.

As counsel, our team advises a party on how to present its case in the most compelling way possible. Based upon our extensive experience in the area of dispute resolution, the team at GcilA is well adapted in the drafting of written arguments or pleadings as well as the close and detailed work with experts used by either party to illustrate detailed technical and/or financial arguments. Our lawyers will also present the case orally in a hearing and use their experience and expertise to skilfully question any witnesses.

When acting as mediators, GcilA’s partners aim to help resolve conflicts as efficiently and cost effectively as possible. Based on decades of experience in highly complex and difficult cases, our lawyers attempt to reach a compromise that permits a deal to move forward on terms that are reasonably satisfactory for both parties. Through the use of various mediation techniques to open and improve the dialogue between two parties and our attention to detail as well as our ability to find creative solutions to any issue, GcilA ensures a successful mediation between the two disputants and avoids the distraction, time and expense of prolonged legal cases.
